A portion of the federal kidnapping statute ( https://www.law.cornell.edu/uscode/text/18/1201 ) is un-constitutional because it permits only a jury to impose the death penalty.

"18 U.S. Code ยง 1201 - Kidnapping" improperly required a defendant to risk the possibility of a death sentence in order to exercise the defendant's constitutional right to a jury trial
