Restitution

Restitution, in contract law in the United States, means returning the payment received. Restitution is an available remedy when a contract or quasi-contract is breached.

In order to obtain restitution, the party seeking restitution must already have rendered partial performance.

Types[edit | edit source]

There are 2 types of restitution:

  1. restitution damages is monetary.
  2. specific restitution is recovery of a thing.

The breaching party will not be entitled to specific restitution--only money (restitution damages).
