Nurse v. Barnes
Court
Citation Sir T. Rayam 77 (1664)
Date decided 1664

Facts

The parties agreed that the plaintiff could use the defendant’s iron mills for six months in exchange for a payment of 10 pounds. The defendant then stopped allowing the plaintiff access to the mills before the six months expired.

Issues

Was the plaintiff entitled to special damages amounting to more than the contract value?

Holding

Damages awarded in the amount of 500 pounds. Damages were found to be the amount of the contract and the value of stock laid in the contract.

Reasons

A loss incurred due to the other party's failure to adhere to contractual obligations result in liability, even if damages exceed the original consideration.
